Welcome to PrivVault. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, uploading files, or using any part of the PrivVault service, you agree to:

• Comply with these Terms of Service
• Comply with our Privacy Policy
• Comply with all applicable laws and regulations
• Be at least 18 years old (or legal age in your jurisdiction)

If you disagree with any part of these terms, you may not use our service.

2. Description of Service

2.1 What We Provide

PrivVault provides zero-knowledge encrypted cloud storage. This means:

• Files are encrypted on your device before upload
• We cannot access, view, or decrypt your files
• Only you possess the encryption keys
• We store encrypted blobs on our servers

2.2 What We Do NOT Provide

PrivVault is NOT:

• A backup service (you should maintain your own backups)
• A file recovery service (we cannot recover lost passwords)
• Responsible for maintaining copies of your encryption keys
• Liable for data loss due to password loss or forgetting

3. Your Account

3.1 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of unauthorized access

3.2 Account Types

• Free Account: 500MB storage, files deleted after 30 days of inactivity
• Paid Account: Pay-as-you-go storage, permanent file retention
• Enterprise Account: Custom storage limits and features

3.3 Your Responsibilities

• Keep your password secure and confidential
• Maintain backup copies of important data
• Monitor your storage usage and billing
• Keep your contact information up to date

4. Prohibited Uses

You agree NOT to use PrivVault for:

4.1 Illegal Content

• Storage of illegal content (child exploitation material, terrorist content, etc.)
• Copyright infringement or pirated content
• Malware, viruses, or malicious code
• Content that violates any law in your or our jurisdiction

4.2 Abusive Behavior

• Attempting to hack, penetrate, or compromise our systems
• DDoS attacks or overwhelming our infrastructure
• Creating multiple accounts to abuse free storage
• Reselling or redistributing our service without permission

4.3 Service Abuse

• Using automated scripts to create fake accounts
• Sharing account credentials with multiple people
• Mining cryptocurrency on our infrastructure
• Hosting public file-sharing websites

5. Payment and Billing

5.1 Pricing

• Current pricing: €1 per 10GB per month (pay-as-you-go)
• Cryptocurrency payments: No processing fee
• Card payments: 10% processing fee
• Prices subject to change with 30 days notice

5.2 Billing

• Billed monthly based on average storage usage
• Automatic renewal unless canceled
• Refunds available within 30 days of purchase
• Failed payments result in service suspension after 7 days

5.3 Account Suspension for Non-Payment

• 7 days grace period after failed payment
• Account suspended after 30 days of non-payment
• Files archived (encrypted) after 60 days
• Permanent deletion after 90 days of non-payment

6. Termination

6.1 Termination by You

You may terminate your account at any time:

• Delete your account through settings
• All files permanently deleted within 30 days
• Refunds available for unused prepaid time
• No refunds for pay-as-you-go usage

6.2 Termination by Us

We may terminate or suspend your account immediately if:

• You violate these Terms of Service
• You engage in illegal activity
• You abuse the service or infrastructure
• We're required by law to terminate service
• Non-payment after grace period

6.3 Effect of Termination

• Access to your account immediately revoked
• Files permanently deleted (we cannot recover them)
• Outstanding balances remain due
• Backup your data before termination if possible

7. Data Ownership and Rights

7.1 Your Content

• You retain all rights to your files and data
• We claim no ownership over your content
• You grant us license to store encrypted copies
• You're responsible for backing up your data

7.2 Our Rights

• We own the PrivVault software, infrastructure, and branding
• We may modify or discontinue features with notice
• We may use aggregate, anonymized data for improvements

8. Disclaimers and Limitations

8.1 Service "As Is"

PrivVault is provided "as is" without warranties of any kind, express or implied. We don't guarantee:

• Uninterrupted or error-free operation
• 100% uptime (though we aim for 99.9%)
• Absolute security against all threats
• Compatibility with all devices or browsers

8.2 Limitation of Liability

To the maximum extent permitted by law:

• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the last 12 months
• We're not liable for password loss or inability to decrypt files
• We're not liable for government seizure or legal compulsion

8.3 Zero-Knowledge Limitations

Due to zero-knowledge encryption:

• We cannot recover lost passwords or encryption keys
• We cannot view, modify, or recover your files
• We cannot comply with requests to decrypt your data
• You accept full responsibility for key management

9. Dispute Resolution

9.1 Governing Law

These terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles.

9.2 Arbitration

Disputes shall be resolved through binding arbitration, except:

• Small claims court claims
• Intellectual property disputes
• Emergency injunctive relief

10. Changes to Terms

We may modify these Terms at any time:

• Notice provided 30 days before significant changes
• Continued use constitutes acceptance
• Right to terminate if you disagree with changes
• Refund available for prepaid time if you terminate

11. Miscellaneous

11.1 Severability

If any provision is found unenforceable, remaining provisions remain in effect.

11.2 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PrivVault.

11.3 No Waiver

Failure to enforce any provision doesn't constitute a waiver of that provision.

11.4 Assignment

You cannot transfer your account. We may transfer our obligations with notice.
